The first sorte of these we have alreadie shewed to belong to princes, to civile lordes and persons, and to be utterly unlawful and forbidden to the ministrie of Christ. Mr. Giffard his liberall maintenance, or the ordinance of the church, cannot mainteine them. Neither will that worde Philoxenos, which they so lardgly stretch and interpreat, carrie half this pompe.317 [142]

To the second sort we affirme these courtes, officers, judges, advocates, proctors, registers, pursevantes, sommoners, together with all their functions, the orders of their courtes, maner of jurisdiction, pleading, etc., where all thinges are pleadable if not vendible for money, where al causes, even the most foule, finde their advocates, colours, defence, delayes, for mony, etc. Al these spiritual courtes, officers, judgments, pleadings, customes, we finde divelish and antichristian, and not to appertaine to the church and kingdome of Christ, but to belong to the kingdome and throne of Antichrist, and of the beaste. And therfore may conclude that they are the revenues of sinne, not to belong to the ministrie of Christ.

The third kinde, these tithes, we finde merely ceremoniall, to have bene ordayned for, and belonged unto, the Leviticall ministerie under the lawe. We finde them an inheritance of the Levites: an offering of the people. Therfore they cannot in this maner by lawe be tyed to the ministrie of Christ, be made an inheritance unto them, an offring of the people unto them. For if there be a chandge of the priesthoode, then of neces sitie must there be a chandge of the lawe. No part 01 the ceremoniall lawe or of those shadowes can be joyned unto the gospell and ministrie of Christ, they or any part of them cannot now be revived or retayned without the denial and losse of Christ. And how is the ceremoniall lawe abrogate whilest these tithes are in this maner allotted by lawe unto the ministrie of the gospell, as an inheritance to them, as an oblation of the people, even as in former tyme unto the Levites? The prince’s commandement, or the churche’s decree, cannot alter the nature of these tithes, to make them either civille or lawfull. God was the aucthor of this law, he made it ecclesiastical. Man can neither chandge the propertie or the end therof, to make that civile that God hath make [made] ecclesiastical. Kinge Ezechia commanded and revived this lawe, it became not ther bie civile.318 A godly prince commandeth al the lawes of the first table, all the ordinances of Christe’s Testament, shall they therbie be made civile, and no longer ecclesiastical or God’s lawes? The decree of the church also (alleadged by Mr. Giffard) sheweth it ecclesiastical, for the church maketh no civile decrees, it medleth not with the execution of civile governement.

Touching the power of the church to make lawes and decrees, we have in the first parte of this booke spoken. The church is bounde to the lawes of God, and may make or receive none other lawes than God hath made.
